HR Tip | MARCH 2026 - The regular meeting as per section 35, Consolidated Act for Occupational Safety

12 March 2026

In companies with more than fifteen employees, there is a meeting that, although it almost never ends up in the spotlight, represents one of the most important moments for the protection of health and safety at work: the periodic meeting required by Article 35 of Legislative Decree 81/2008.

This is a mandatory meeting, which must take place at least once a year or whenever there are significant changes in risk conditions. The employer (or their representative), the Head of the Prevention and Protection Service (RSPP), the Workers' Safety Representative (RLS), and the competent doctor, when appointed, sit around the same table. This composition reflects the collegial nature of prevention: different roles, different skills, a single goal.

During the meeting, participants analyze the main tools and indicators of corporate safety. They start with the Risk Assessment Document (DVR), the “map” of hazards present in the company, and then move on to the trend of accidents and occupational diseases, the personal protective equipment used, and its adequacy. There are also more proactive discussions dedicated to identifying best practices, codes of conduct, and objectives for improving the level of internal safety.

At the end of the meeting, minutes are drawn up, a fundamental document that records what has been discussed and decided, and which remains available to all participants. This is anything but a formal step, because the traceability of assessments and choices is one of the most solid guarantees in terms of prevention.

The law, after all, leaves no room for carelessness. Failure to convene the periodic meeting, the absence of minutes, or the omission of mandatory topics will result in penalties for the employer and the manager responsible. The penalties can be criminal (fines) or administrative, ranging from $500 to $6,600.

It is therefore an obligation, but also an opportunity: the periodic meeting is one of the few moments when the company stops to take a clear look at its safety system, discuss it openly, and plan concrete improvements. It is an exercise in responsibility that, when carried out seriously, can really make a difference.
